These terms and conditions apply to the computer services provided by Aussie Tech Experts IT Services (the “Business”) to you (the “Customer”). By booking or purchasing any computer service from the Business, you agree to be bound by these terms and conditions.
- Services
The Business offers a range of computer services, including:Computer Repair: The Business can diagnose and fix various computer problems, such as hardware failures, software errors, virus infections, data recovery, and more. - System Troubleshooting: The Business can identify and solve system-related issues, such as network configuration, security settings, performance optimization, and more.
Website Migration: The Business can help you transfer your website to a new platform, host, or domain, without losing any data or functionality.
Small Office Setup: The Business can help you set up your IT infrastructure for your small business, such as network installation, hardware setup, software installation, and more.
Computer Assembly: The Business can help you build your own custom computer, according to your specifications and preferences.
The Business will provide the computer services in a professional and timely manner, using reasonable care and skill. The Business will use its best efforts to achieve the desired results, but does not guarantee that the computer services will be error-free, uninterrupted, or completely satisfactory.
- Fees and Payment
The Business will charge you a fee for the computer services, based on the type, duration, and complexity of the service. The Business will inform you of the fee before commencing the service, and will provide you with an invoice and a receipt upon completion of the service. The fee may include the cost of any parts, materials, or software used or supplied by the Business for the service.
You agree to pay the fee in full within 14 days of receiving the invoice, unless otherwise agreed by the Business. You can pay the fee by cash, cheque, credit card, or bank transfer, as specified by the Business. If you fail to pay the fee on time, the Business may charge you interest at the rate of 10% per annum, and may take legal action to recover the fee and any costs incurred. - Warranty
The Business warrants that the computer services will be free from defects in workmanship and materials for a period of 90 days from the date of completion of the service. If you discover any defects in the computer services within the warranty period, you must notify the Business as soon as possible, and provide proof of purchase and a description of the defect. The Business will then, at its option, either:Repair the defect at no extra charge
Replace the defective part, material, or software at no extra charge
Refund the fee paid for the service
The warranty does not cover any defects caused by:Your misuse, abuse, negligence, or modification of the computer or the service
Any external factors, such as power surges, accidents, fire, water, theft, or vandalism
Any software or hardware not supplied or approved by the Business
The warranty is in addition to your statutory rights under the Australian Consumer Law, which may entitle you to a repair, replacement, refund, or cancellation if there is a major problem with the computer service.
- Liability
To the extent permitted by law, the Business is not liable for any loss or damage arising from or in connection with the computer services, including:Any loss or corruption of data, software, or hardware
Any loss of profit, revenue, or goodwill
Any loss or damage to your computer or any other property
Any personal injury or death
The Business’s liability for any breach of these terms and conditions or any applicable law is limited to the amount of the fee paid for the computer service, or the resupply of the computer service, whichever the Business chooses. You agree to indemnify the Business from and against any claims, liabilities, costs, or expenses arising from or in connection with your breach of these terms and conditions or your misuse of the computer service.

The Business may terminate the computer service at any time, without notice or penalty, if:You fail to pay the fee or any other amount due to the Business
You breach any of these terms and conditions or any applicable law
You provide false, misleading, or incomplete information to the Business
The Business considers that the computer service is impractical, unsafe, or unlawful
You may terminate the computer service at any time, without notice or penalty, if:The Business breaches any of these terms and conditions or any applicable law
The Business fails to provide the computer service within a reasonable time or as agreed
You are entitled to a cancellation under the Australian Consumer Law
If the computer service is terminated, you must pay the Business for any work done or costs incurred up to the date of termination, and return any parts, materials, or software supplied by the Business. The Business will refund any fee paid in advance for any work not done or costs not incurred.

The Business respects your privacy and will handle your personal information in accordance with its privacy policy, which is available on its website or upon request. The Business may collect, use, disclose, and store your personal information for the purposes of providing the computer service, communicating with you, processing your payments, improving its products and services, and complying with its legal obligations. The Business may share your personal information with its business partners, contractors, service providers, or government agencies, as necessary or authorised by law. You have the right to access and correct your personal information, and to make a complaint or provide feedback, by contacting the Business using the details below. - General
These terms and conditions constitute the entire agreement between you and the Business in relation to the computer service, and supersede any previous or inconsistent agreements, representations, or communications. These terms and conditions are governed by the laws of New South Wales, and you and the Business submit to the exclusive jurisdiction of the courts of New South Wales. If any part of these terms and conditions is invalid, illegal, or unenforceable, it will be severed and the rest of the terms and conditions will remain in force. The Business may assign or subcontract its rights and obligations under these terms and conditions to any third party, without your consent.
